Whether Swiggy Can Share Confidential Data With Restaurant Association? Karnataka High Court Directs CCI To Decide Afresh

The Karnataka High Court directed Competition Commission of India to decide afresh whether swiggy can share confidential data with restaurant association.

By the common order, the respondent – Commission allowed the application filed by the petitioner requesting the Commission to create a confidentiality ring and also allowed the application filed by the other respondent to include its authorised representatives in the said confidentiality ring.  

Counsel for both the parties jointly submitted that without prejudice to their rights and contentions and keeping / leaving open all contentions, the order may be set aside and the matter be remitted back to the respondent – Commission for reconsideration afresh of both the applications filed by the petitioner as well as the 2nd respondent afresh in accordance with law after providing an opportunity to both the petitioner and 2nd respondent and hearing them in this regard. 

The bench set aside the order and remitted the matter back to the respondent – Commission for reconsideration of both the application filed by the petitioner as well as the application filed by the 2 nd respondent in accordance with law as expeditiously as possible, after providing an opportunity to both the petitioner and 2nd respondent and hearing them in this regard.
