The Jharkhand High Court has granted anticipatory bail to the truck driver who was allegedly involved in loading tonnes of illegal coal.

The High Court has enlarged the petitioner on anticipatory bail. The court stated that in the event of his arrest/surrender within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Bashistanagar P.S. Case No. 55/2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.

Facts

The petitioner apprehended his arrest for the offences punishable under Sections 406/414/419/420/467/468/ 469/471/120-B of the Indian Penal Code and Section 30(2) of the Coal Mines (Nationalisation) Act, 1973.

The petitioner is the owner of the truck bearing registration no. UP-67AT-2025 which was allegedly found loaded with 29.81 tonnes of illegal coal. It has also been alleged that the quantity of coal was being transported by the said vehicle from Amrapali Project of CCL to Varanasi with forged papers for illegal sale. As per the petitioner, the truck was accompanying the genuine papers such as, GST delivery challan, transportation challan etc.

The petitioner has no criminal antecedent as has been stated in the present application. The petitioner undertakes to co-operate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail.

Conclusion

The Jharkhand High Court granted the truck driver anticipatory bail by imposing the requisite conditions.
