The GST Appellate Tribunal (GSTAT) website goes live but the link is not opening.

The much-anticipated website of the Goods and Services Tax Appellate Tribunal (GSTAT) is now live, marking a significant milestone in India’s tax litigation system. 

The portal, accessible at gstat.gov.in, is currently in its initial phase with limited access to features, including the ‘File an Appeal’ option. Authorities have clarified that the time limit for filing appeals has not been triggered yet, and stakeholders are advised to stay tuned for further updates.

A National Tribunal for GST Disputes

The GSTAT has been established by the Government of India under Section 109 of the Central Goods and Services Tax Act, 2017, to hear appeals against decisions made by Appellate or Revisional authorities under Sections 107 and 108. Additionally, the tribunal has the authority to adjudicate anti-profiteering cases under Section 171 of the Act.

As a national tribunal, the GSTAT is headquartered in New Delhi with 31 State Benches spread across various States and Union Territories. These benches will conduct sittings in 44 different locations across India, ensuring accessibility for taxpayers and litigants nationwide.

Leadership and Structure

The tribunal is headed by a President, who must be either a Supreme Court Judge or a past/present Chief Justice of a High Court. The Principal Bench in New Delhi consists of the President, one Judicial Member, and two Technical Members—one representing the Centre and the other the States.

Each of the other benches comprises four members: two Judicial Members and two Technical Members (one from the Centre and one from the respective State). While Judicial Members come from the legal profession or judiciary, Technical Members are senior tax or revenue officers from the Central or State Governments.

Fully Digital and Hybrid Hearings

In a groundbreaking move, GSTAT has become India’s first tribunal to be fully digital from its inception. Appeals will be filed electronically via the e-filing portal, with document uploads and processing managed through a Case Information System and Document Management System. Orders issued by the tribunal will also be available online, ensuring transparency and real-time updates for litigants.

To enhance accessibility, GSTAT hearings will be conducted in a hybrid mode, offering stakeholders the flexibility to opt for physical hearings or attend proceedings remotely from any location.

With the launch of its digital platform, GSTAT is set to revolutionize GST dispute resolution in India, providing an efficient and transparent mechanism for taxpayers and businesses. The introduction of real-time case tracking and hybrid hearings is expected to streamline litigation and reduce procedural delays.
